One of the main purposes of Bankruptcy Law is to give a person, who is hopelessly burdened with debt, a fresh start by discharging those debts that are dischargeable.

In most Chapter 7 Bankruptcy filings eligible debts are discharged in a process that takes approximately four months. In a significant majority of cases the filer has no assets that would be lost. Of course all cases are different and after consultation with an experienced attorney the extent of any loss would be better explained. Chapter 7 bankruptcy gives a person a relatively quick "fresh start".
A Chapter 13 Bankruptcy is for people who want to pay off part of their debts over a period of three to five years.

There has been much doom and gloom written about the new bankruptcy laws and how much more difficult it is to file Chapter 7 bankruptcy. It's true that there are more hoops to jump through under the new bankruptcy laws and it's true that some people will have to file chapter 13 bankruptcy instead of Chapter 7 bankruptcy.
